1.1. Welcome to HEARTS Collaborative, Inc.’s (“HEARTS”) website. By accessing or using the HEARTS (“we”, “our”, or “us”) website (the "Site"), you agree to comply with and be bound by these Website Terms of Use and Conditions (the "Terms"). Please read these Terms carefully before using the Site. If you do not agree to these Terms, you should not use the Site.
2. Acceptance of Terms
2.1. These Terms apply to all users of the Site, including without limitation users who are browsers, vendors, customers, members, and/or contributors of content.
2.2. By using the Site, you agree to abide by these Terms, as well as any additional terms, conditions, or policies referenced herein and/or available by hyperlink.

3.1. By using the Site, you agree to use the Site only for lawful purposes and not to use the Site in any way that breaches any applicable local, national, or international law or regulation.
3.2. You also agree to use the Site in a manner that does not infringe the rights or privacy of, or to restrict or inhibit anyone else's use and enjoyment of the Site.
4. Site Subscriptions and Email Newsletters
4.1 The aim of the Site’s newsletter service is to keep the public, HEARTS members, and Site visitors updated about our impact, our programming and initiatives, and to feature new local events and other relevant information aligned with our mission & goals.
4.2. By subscribing to the Site, reserving admission to a HEARTS Happening event or a HEARTS Affiliate event tickets on the Site, or otherwise providing an email address to the Site or the Site’s self-appointed representatives, you agree to receive emails, newsletters, membership information, and other communications from the Site.
4.3. You may opt out of receiving the newsletter by following the unsubscribe instructions included in every email.
5. Event Reservations and Admission Tickets
5.1. You may use the Site to make an event reservation and/or to purchase admission tickets for events listed on the HEARTS Happenings event calendar on the Site.
5.2. You cannot use the Site to make an event reservation or purchase admission tickets for all events listed on the Site’s Community Events Calendar. The Site’s Community Events calendar is a collaborative version of publicly accessible event information. Admission for and inquiries about those events must be made to the named event host, credited site, or location source linked to that Community Event.
5.3. By making an event reservation or purchasing admission tickets to a HEARTS event or a HEARTS Affiliate’s event through the Site, you agree to provide accurate and current information about yourself and/or your group as prompted by the event reservation or admission ticket purchase form.
5.4. Payment for event admission, if required, must be made at the time of reservation. You will receive a confirmation email upon successful reservation and payment.
5.5. Event cancellations and refunds for event admission tickets are subject to the Event Cancellation and Refund Policy, which is available on the Site.
5.6. All event reservations and admission ticket purchases are subject to availability and acceptance by HEARTS or by its appointed representatives. HEARTS reserves the right to refuse or cancel reservations at its discretion and with or without notice.
6. Online Donations
6.1. The Site accepts online donations to the HEARTS through a third-party vendor.
6.2. You acknowledge that you will be redirected to our third-party service provider to make a donation.
6.3. You agree to provide accurate and complete information when making a donation.
6.4. You warrant that they have the legal right to use the credit or debit card or other payment method they use to make the donation.
6.5. All donations are non-refundable.
6.6. All donations will be used to further the mission of HEARTS as described on the Site.
6.7. The monetary value of all donations made to HEARTS, a federally recognized 501(c)3 nonprofit charity organization, EIN: 93-3594985, are tax deductible to the fullest extent of the law.
7. Memberships and Dues
7.1. The Site allows Users to become a site member by selecting and purchasing a one (1) year membership at and paying membership dues online. Users must complete the membership application form available on the Site and pay the applicable membership dues to become a member.
7.2. Members will receive benefits as described on the Site, which may include newsletters, event invitations, and access to exclusive content.
7.3. Memberships are automatically renewed annually on the date of expiration. Members may cancel their membership(s) at any time.
7.4. Memberships are subject to acceptance by HEARTS, or by its self-appointed representatives, and reserves the right to refuse membership applications at its discretion and with or without notice.
7.5. All membership dues are considered a donation to the HEARTS Collaborative, Inc. and are non-refundable, except as required by applicable law.
7.6. The monetary value of all donations made to HEARTS, a federally recognized 501(c)3 nonprofit charity organization, EIN: 93-3594985, are tax deductible to the fullest extent of the law.
8. Intellectual Property
8.1. All content included on the Site, such as text, graphics, logos, images, and software, is the property of HEARTS or its content suppliers and is protected by international property laws. The compilation of all content on this Site is the exclusive property of HEARTS.
8.1. You agree not to use any of the Site’s intellectual property without the HEARTS’s express written consent.
9. Privacy
9.1. HEARTS Collaborative, Inc.’s Privacy Policy explains how it collects, stores, and protects the personal information of Site Users.
9.2. By using the Site, you consent to the collection, storage, and use of their personal information as described in the Privacy Policy.
10. Disclaimer and Limitation of Liability
10.1. The Site is provided "as is" and "as available" without any representations or warranties of any kind, express or implied. The Site is not warranted to be uninterrupted or error-free.
10.2. While every measure is taken to share accurate and up to date information, the Site, HEARTS, HEARTS Affiliates, nor any appointed representative makes no representations or warranties in relation to this Site or the information and materials provided on this Site.
11. Indemnification
11.1. You agree to indemnify, defend, and hold harmless HEARTS Collaborative, Inc, its directors, officers, employees, consultants, volunteers, or affiliates against any and all demands, loss, liability, claims or expenses (including attorneys' fees), made against them.
12. Governing Law
12.1. This Policy is governed by the laws of North Carolina. Any legal claims or lawsuits related to the precipitants in the program shall take place in courts located in Mecklenburg County, North Carolina.
13. Review of Policy
13.1. This Policy shall be reviewed annually by the Nonprofit’s Board of Directors and any proposed changes shall be submitted to the Board for approval.
14. Adoption and Amendments
14.1. This Policy was adopted by the Board of Directors on January 1,2025.
14.2. Amendments to this Policy must be approved by a majority vote of the Board.
15. Severability
15.1. If one part of this Policy is deemed invalid, the rest of the Policy remains enforceable.
16. Entire Agreement
16.1. This Website Terms and Conditions Policy represents the entire agreement between the User and the Site, HEARTS, and its appointed representatives.

1.1. By accessing and using the HEARTS Collaborative, Inc. (the “Nonprofit”) website (the “Site”) to register to attend an event sponsored, organized, and/or hosted by HEARTS and/or HEARTS Affiliates), the Site guest (the “User”) agrees to comply with and be bound by these Event Policy Terms (the "Terms"). Please read these Terms carefully before registering to attend an event. If the User does not agree to these Terms, the User should not register to attend an event.
2. Acceptance of Terms
2.1. These Terms apply to all users of the Site, including without limitation users who are browsers, vendors, customers, members, and/or contributors of content.
2.2. By using the Site, the User agrees to abide by these Terms, as well as any additional terms, conditions, or policies referenced herein and/or available by hyperlink.
3. Event Registration
3.1. Users may use the Site to make an event reservation and/or to purchase admission tickets for events listed on any calendar of events on the Nonprofit’s Site.
3.2. Users cannot use the Site to make an event reservation or purchase admission tickets for all events listed on the Site’s calendar of events when the Site discloses that the event details were obtained from a publicly accessible source. Admission for and inquiries about these events must be made directly to the named event host, event location, or the source of that events’ details.
3.3. All registrations for HEARTS events must be completed through the Nonprofit’s official website or our designated registration platform.
3.4. By making a reservation or purchasing a ticket to a Nonprofit event or to the event of an Affiliate of the Nonprofit through the Site, the User agrees he/she has provided accurate and current information about him or herself as prompted by the event reservation form.
3.5. The User will receive a confirmation email upon successful reservation and payment, if applicable.
3.6. All event reservations are subject to availability and acceptance by the Nonprofit or by its appointed representatives. The Nonprofit reserves the right to refuse or cancel reservations at its discretion and with or without notice.
4. Event Admission Payment
4.1. If payment for event registration is required to attend the event, payment in full is due at the time of booking to secure the event registration.
4.2. By purchasing admission tickets to a HEARTS event or a HEARTS Affiliate’s event through the Site, the User agrees to provide accurate and current payment information about him or herself as prompted by the event admission ticket purchase form.
4.3. Registration fees may include applicable taxes and processing fees, which will be clearly stated at checkout.
4.4. The User will receive a confirmation email upon successful reservation and payment.
4.5. All event admission payments are subject to availability and acceptance by the Nonprofit or by its appointed representatives. The Nonprofit reserves the right to refuse or cancel event reservations and/or payments at its discretion and with or without notice.
5. Event Changes
5.1. The Nonprofit reserves the right to make changes to the event schedule, location, speakers, or activities as deemed necessary.
5.2. Any significant changes will be communicated to participants by the Nonprofit via email or through the event’s official communication channels.
6. Event Cancellation Notice
6.1. Cancellation by the Nonprofit
6.1.1. The Nonprofit reserves the right to cancel or reschedule the event due to unforeseen circumstances, including but not limited to insufficient attendance, extreme weather conditions, or other force majeure events.
6.1.2. In the event of cancellation by the Nonprofit, all registered participants will be notified as soon as possible via email or phone.
6.1.3. Additionally, all registered participants who previously submitted payment when required for event admission, will be provided a period of fifteen (15) days to request in writing a refund of their paid event admission ticket price, minus any applicable taxes and processing fees, or to continue with their payment as a donation to the Nonprofit.
6.1.4. The monetary value of donations made to HEARTS, a federally recognized 501(c)3 nonprofit charity organization, EIN: 93-3594985, are tax deductible to the fullest extent of the law.
6.2. Cancellation by the Participant
6.2.1 If a registered guest needs to cancel his or her single registration or group registration, the guest(s) should notify the Nonprofit in writing via email at info@heartscollaborative.org, but it is not required.
6.2.2. There is no penalty for a registered event guest who fails to attend an event.
7. Refund Policy
7.1. Nonprofit event admission is considered a donation to the Nonprofits’ stated mission and goals and, therefore, event registration is not eligible for a refund in part or in full, unless the event is cancelled by the Nonprofit as stated above in section 6.1.3.
7.2. Donations made to the Nonprofit during event registration and/or at any time during or after the event, whether in person, online, or by postal mail, are non-refundable.
7.3. The monetary value of all donations made to HEARTS, a federally recognized 501(c)3 nonprofit charity organization, EIN: 93-3594985, are tax deductible to the fullest extent of the law.
7.4. All applicable taxes and processing fees, if any, are also non-refundable.
8. Disclaimer, Limitation, and Release of Liability
8.1. While every measure is taken to share accurate and up to date information, the Nonprofit nor any appointed representative makes no representations or warranties in relation to the information and/or materials provided during the event.
8.2. The Nonprofit, its directors, officers, employees, volunteers, and affiliates are not responsible for any personal injury, illness, allergic reaction, loss or damage, or for any loss or harm to the personal property of any event guest that may occur as a result of a guests’ attendance or participation at the event.
8.3. The User and his or her invited guests agree to release and hold harmless the Nonprofit, its directors, officers, employees, volunteers, and affiliates from any and all liability, claims, damages, or expenses arising out of or related to their attendance and/or participation at the event, including but not limited to personal injury, illness, allergic reaction, or other harm that may result from the User’ attendance and/or participation in the event preparation, handling, or consumption of such food or beverages.
8.4. The User and his or her invited guests agree to release and hold harmless the Nonprofit, its directors, officers, employees, volunteers, and affiliates against any claims or actions brought by the User, his or her event guests, and/or by third parties resulting from the Users’ or his or her guests’ actions related to food or beverage consumption during the event.
8.5. Event guests are responsible for their own travel arrangements, accommodations, and associated costs unless otherwise stated.
9. Photography Release
9.1. By attending this event, the User and his or her guests consent to being photographed and/or recorded, and grantd the Nonprofit unlimited permission to use such media for promotional purposes indefinitely.
